Council resolution following code of conduct investigationApril 23, 2026 Media release from Oberon Council Issued April 21, 2026 On behalf of Oberon Council, I wish to inform the community that Council, at its Ordinary Meeting held on 21 April 2026, has considered the findings of an independent Code of Conduct investigation relating to the conduct of a Councillor. Following receipt of the independent Final Investigation Report, Council resolved to formally censure Councillor Helen Hayden for misconduct under section 440G of the Local Government Act 1993 (NSW). In making this decision, Council accepted the findings of the investigation, which determined that Councillor Hayden breached the Code of Conduct. The findings further identified that this conduct caused distress and harm to members of the community, including grieving families, as well as Council staff, and adversely impacted public confidence in Council. Council further resolved to refer the matter to the Office of Local Government with a recommendation that Councillor Hayden be removed as a Councillor immediately and be barred for nominating for Council for a period of five years. Councillor Hayden has also been removed as a delegate and representative from all committees of the Council on which she has been appointed. This matter has been managed through a formal, independent and procedurally fair investigation process, conducted in accordance with the Model Code of Conduct and legislative requirements. It is important the community understands that all parties are afforded due process and findings are determined impartially based on evidence. At the same time, Council has heard the concerns raised by the community. The impact of this matter has been significant, and it is not taken lightly. Respect, kindness and the wellbeing of our community and staff must always come first. The total cost of the investigation was $12,540 (including GST), which reflects the complexity and seriousness of the issues considered, and Council's commitment to ensuring the matter was dealt with appropriately. Consistent with the confidentiality requirements set out in the Local Government Act and Model Code Procedures, further detail regarding the complaints or investigation findings cannot be provided. Councillors are elected to serve the community and hold positions of public trust, and with that trust comes a clear responsibility to act with integrity, respect and sound judgement always. Where conduct falls short of these standards, Council has a clear obligation to respond in accordance with the powers available to it. Tonight's resolution reinforces the expectation that all Councillors will act with integrity, respect and professionalism, and affirms Council's commitment to accountability, transparency and respectful leadership on behalf of the Oberon community.
